Oh No! What to Do When Your Cargo is Damaged

Packing is a really important part of the shipping process.  The way cargo is loaded onto a vessel can greatly determine the condition of the cargo once it is received.  No one wants that sinking feeling of receiving a shipment from abroad only to open the container and find the goods inside damaged in some way.  Still, even with the best of packing care, it’s possible that your cargo will be damaged in some way at some point in time, despite your best intentions.  What should you do if you discover damaged cargo?

First, understand what “damage” might actually be.  Obviously, if you open up the container and see damage, that is a sign.  But damage can also include spotting a damaged container or if the container seal is broken when you receive it.  In any of these scenarios, the first thing you should do is immediately call the insurance company.  Then contact the shipping line.

Don’t start unpacking the cargo without the shipping line representative – or any other representative – being present.  This is a critical part of the process in orer to prove that the items inside the containers were properly inspected by all parties and the damage is noted by everyone. If you don’t take this step, your claims may have a much more difficult time getting approved and reimbursed.

Once the insurance company is contacted, expect that the shipping line will probably dispute your claim.  After all, the packing usually falls under the shipper’s responsibility, while the handling of the cargo is the shipping line’s responsibility.  Certain kinds of damage (like water damage) change this responsibility somewhat, but don’t be dismayed if the shipping line’s first reaction is “Not our fault.”

Some shipping vessels can only carry certain kinds or quantities of hazardous materials.  So if you recommend your own vessel, the shipping company will do an immediate check to determine whether what you chose will work.  This can vary even from port to port.  You will need to fill out a packing declaration and have a copy for the shipping line.  This is the most critical document of the lot!  Misdeclarations can cost you big time; in some cases, it has even cost port workers their very lives.

Containers must be packed according to the hazardous specifications.  Don’t assume that just because you have the go-ahead to ship hazardous materials that the work is done yet!  This is one of the most important parts.  The identification of a hazardous container is critical for proper storage and handling.  Clients who skip this step often find their cargo will not ship, as a port won’t accept any hazardous container without all the proper labels on all four sides of the container.  Details matter!

What is a Letter of Credit? Do I Need One?

Letters of credit are sometimes a necessary part of a shipping transaction.  In simple terms, banks need a guarantee of payment, and a letter of credit is a method of guaranteeing that a shipper will get paid and that the purchaser will actually get the shipment.  In reality, though, there are pitfalls and caveats when it comes to letters of credit.  Here is what you need to know.

First, a letter of credit is not really a guarantee that payment will be made and the shipment will be done properly.  It is the a good method, but not flawless.  Other considerations are to make oneself aware of the full charges the bank will levy (or could charge) and add those costs against the purchase price to cover against possible loss.  Many a first-time shipper has found that profits are quickly eaten up because the bank charges more than they expected in fees.

In some disaster scenarios, the wording on the letter of credit has made it nearly impossible for the shipper to get paid, or because the term “irrevocable confirmed” wasn’t used, then the letter of credit is thrown out.  Even with the proper stamps and signatures, that isn’t a full guarantee; after all, it isn’t as though the certifying agencies actually open a box to ensure that what is in the box works, is the right color, etc.
